Expungement in New Jersey
An old arrest or conviction can still show up on background checks for jobs, housing and licenses. New Jersey’s expungement law lets eligible people petition the Superior Court to isolate those records from public view. The Legal Assistance Center prepares expungement petitions for arrests without conviction, disorderly persons convictions, eligible indictable convictions, and Clean Slate petitions.
Is your record eligible?
Eligibility depends on the type of offense, how many convictions you have, and how much time has passed since the conviction, fine, probation or release. Some offenses can never be expunged. Expungement in New Jersey, including Clean Slate sets out the waiting periods in a table.
How the process works
- Record review. Gather your complete record, including every arrest, charge and outcome.
- Eligibility check. Match the record against the statute’s waiting periods and exceptions.
- Petition. Prepare and file the petition with the Superior Court.
- The order. If granted, the order goes to the agencies holding the records.
Expungement is part of Danielle Joseph-Key’s criminal defense practice. If a pending charge is the issue, start there. A conviction tied to a domestic matter may also affect restraining order or custody questions, so mention it at your free consultation.
- Arrests without a conviction
Dismissed charges, conditional discharges and conditional dismissals.
- Disorderly persons convictions
Municipal court convictions after the waiting period in the statute.
- Indictable convictions and Clean Slate
Petitions for eligible indictable convictions, and Clean Slate petitions for people who meet the 10-year requirement.
