Contested and uncontested divorce, equitable distribution of assets, alimony and marital settlement agreements in New Jersey, from attorney Danielle Joseph-Key, Esq.

Divorce in New Jersey

A divorce settles more than the marriage. It decides who keeps which assets and debts, whether either spouse pays alimony, and, when there are children, custody, parenting time and support. The Legal Assistance Center represents New Jersey clients in contested and uncontested divorces in the Family Part.

Danielle Joseph-Key, Esq. has more than 25 years of New Jersey practice. Her divorce work covers equitable distribution, alimony and spousal support, and marital property settlement agreements.

What is decided in a divorce

  • Property and debts. Marital assets and debts are divided through equitable distribution.
  • Support. Alimony for a spouse and child support for children under the Child Support Guidelines.
  • Children. Custody and parenting time, set out in a parenting plan or decided by the court.

Settling or going to court

Many New Jersey divorces settle, often after mediation. A settlement is written into a marital settlement agreement, and what it says is hard to undo later, so it should be reviewed before you sign. When issues cannot be settled, they are tried before a Family Part judge.

If you want to handle your own divorce, Advice & Counsel offers flat-fee strategy sessions, document review and settlement agreement review. After the divorce, changes to support or custody are handled through post-judgment motions. For the custody side, read how New Jersey courts decide child custody.

  • Contested and uncontested divorce

From an agreed divorce where the papers need to be right, to a contested case with open issues on property, support or children.

  • Equitable distribution

Division of marital assets and debts. New Jersey divides marital property equitably, which does not always mean equally.

  • Marital settlement agreements

Drafting and review of the agreement that sets out property, support, custody and parenting time terms.

  • Do I have to prove fault to divorce in New Jersey?

No. New Jersey allows divorce on the ground of irreconcilable differences that have lasted at least six months and make it appear the marriage should be dissolved, with no reasonable prospect of reconciliation. Fault grounds also exist under the statute.

  • Can I get a settlement agreement reviewed without hiring a lawyer for the whole divorce?

Yes. Settlement agreement review is one of the Advice & Counsel services. Danielle reviews the proposed agreement clause by clause before you sign, billed under the Advice & Counsel pricing schedule.
